(2) The WTO provides the status of negotiations among its members on multilateral trade relations in the cases under this agreement. The WTO can also provide a forum for further negotiations among its members on their multilateral trade relations and a framework for the implementation of the outcome of these negotiations, as decided by the Ministerial Conference. … We draw attention to the fact that the multilateral interpretations adopted in accordance with Article IX:2 of the WTO agreement, on the one hand, and subsequent interpretive agreements within the meaning of Article 31, paragraph 3, point a), of the Vienna Convention, perform different functions and have different legal effects under WTO law. Multilateral interpretations under Article IX:2 of the WTO agreement provide a means by which members – who act through the highest levels of the WTO – can adopt binding interpretations that clarify WTO law for all members. Such interpretations are binding on all members, including all disputes in which such interpretations are relevant. 43 In Document No. 8, p. 5 above, the United States emphasized that “the authors of the amendments to the WTO agreement were particularly sensitive to the possibility that a future WTO member might one day attempt to undermine the intent of the agreement by interpreting agreements or amendments that not all members saw as in their interest. That is why, in the last sentence of Article IX:2, the authors made it clear that they could not be used to undermine the provisions of Article X.
